1. Agreement

These Terms of Use ("Terms") apply to smartbuildsbrightwealth.com, our free guide, our virtual Strategy Sessions and our investor portal, all offered by Smart Builds Bright Wealth ("Smart Builds," "we," "us"). By using them, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our website. You must be at least 18 years old to use our services.

2. What Smart Builds does

Smart Builds provides construction management for new single-story residential homes in Jupiter, Stuart, Port St. Lucie, Fort Pierce, Vero Beach, Melbourne and Palm Bay, Florida. We manage your build at real cost plus a fixed fee. We do not sell homes, we do not have model homes, and we do not provide our own house plans.

3. This website is not a contract

Everything on this website, in our guide, in our emails and on our social media is general information. It is not an offer, a quote or a contract. Browsing the site, downloading the guide or booking a Strategy Session does not create a business relationship between you and Smart Builds.

Our services are governed only by a written contract signed by you and Smart Builds. We do not start any work on your project (such as reviewing your lot, introducing you to an engineer or preparing your budget) until the contract is signed and payment is received. If the contract and these Terms ever disagree, the contract prevails.

4. Estimates, not promises

• Savings: the 20–30% savings we mention is an estimated range compared with a builder's price. It depends on the market and on each project, and your result may fall inside or outside that range. It is not a promise.
• Timeline: about 7 months after permits is a target. It depends on permits, inspections, weather, suppliers and other third parties. We do not control how long the building jurisdiction takes to issue permits.
• Build costs: any budget per trade is approximate. Final costs are known only when materials are bought, and they change with your choices, the timing of purchases and market prices (for example, lumber, block and steel). We recommend a 5–10% contingency, which always stays with you.
• Strategy Sessions: they are a first approach. Without real project information, we cannot guarantee exact numbers.

5. No professional advice

Our content is not legal, tax, accounting, lending, investment or real estate brokerage advice. Smart Builds is not a realtor and does not find lots for clients. Investing in real estate involves risk, including the loss of money. Before you make a decision, talk to your own qualified professionals.

6. Independent professionals

If you ask, we may introduce you to an independent licensed engineer or an independent realtor. You hire and pay them directly, under their own terms. They are not Smart Builds employees or agents, and we are not responsible for their services, advice or results.

7. Free guide and Strategy Sessions

• Guide: "The Formula That Never Fails – Investor Strategy Guide" is free for your personal use. You may share the link to our website, but you may not sell, copy or republish the guide without our written permission.
• Strategy Sessions: free, virtual 30-minute video calls by Zoom, with no commitment. We may reschedule or decline a booking. Please do not share information on the call that you do not want us to keep under our Privacy Policy.

8. Investor portal and payments

• Access: the investor portal is only for our clients and the people they authorize. Keep your login private; you are responsible for activity on your account. Tell us right away if you think someone used it without permission. We may suspend access to protect your project or the portal.
• Your project content: documents, reports and camera video in the portal are for your project. You may share them with your own advisors, lenders or partners, but not publish them without our consent, because they can show workers, addresses and other people's information.
• After closing: your access stays open for one month after closing, then it is closed unless you have another project with us. Download what you need before then; your closing package is delivered as PDF files.
• Payments: online payments (ACH or card) are handled by a payment provider, which may charge its own fees. All funds must come from a U.S. bank account that belongs to you or to a company you own or control, as shown by a bank-issued document. Payment amounts and dates are set in your contract.

9. Acceptable use

When you use our website or portal, you agree not to:

• break any law or use our services for fraud or money laundering;
• give false information or pretend to be someone else;
• try to access accounts, systems or data that are not yours;
• send spam, viruses or harmful code, or overload the site;
• copy or scrape our content in bulk with automated tools.

10. Our content

The text, images, videos, logo, brand name, design and guide on this website belong to Smart Builds or are used with permission, and are protected by copyright and trademark laws. You may view and share our pages for personal, non-commercial purposes. Any other use needs our written permission.

11. Third-party links and services

Our website links to services run by other companies, such as Instagram, LinkedIn, Zoom and our online scheduling page. We do not control them and are not responsible for their content or practices. Their own terms and privacy policies apply.

12. Disclaimers and limitation of liability

We work to keep this website accurate and available, but it is provided "as is" and "as available." Information may change or become outdated, and we do not guarantee the site will be error-free or uninterrupted.

To the fullest extent the law allows, Smart Builds is not liable for indirect, incidental, special or consequential damages, or for lost profits, arising from your use of this website, the guide or the Strategy Sessions. For any claim related to the website, our total liability is limited to US$100. This section does not limit your rights under a signed contract with us, or any rights that the law does not allow us to limit.

You agree to cover the reasonable losses and costs that Smart Builds suffers because you broke these Terms or misused our website.

13. Governing law

These Terms are governed by the laws of the State of Florida and of the United States, without regard to conflict-of-law rules. Any dispute about these Terms will be handled by the state or federal courts located in Florida. If you live in the EU, the UK or another country with mandatory consumer protection laws, you keep the rights those laws give you.

14. Changes and other terms

We may update these Terms. We will change the "Last updated" date at the top, and the new version applies from that date. If any part of these Terms cannot be enforced, the rest still applies. If we do not enforce a part right away, we do not give up the right to enforce it later.
