1. Who we are
Smart Builds Bright Wealth ("Smart Builds," "we," "us") provides construction management for new single-story homes in Southeast Florida, from Jupiter to Melbourne. We are responsible for the personal information described in this policy. Under the EU and UK General Data Protection Regulation (GDPR), we are the "controller" of that information.
This policy applies to smartbuildsbrightwealth.com, our emails, our virtual Strategy Sessions, our investor portal and our contractor registration form. It does not apply to other websites we link to, which have their own policies.
2. Information we collect
Information you give us
- Free guide sign-up: your first and last name, your email address and your consent to receive the guide and our emails, whether you sign up on our website or request the guide by direct message on Instagram. When you request it on Instagram, we also see your Instagram username and the messages you send us in that conversation.
- Strategy Session booking: your name, your email, your time zone and the time you choose. During the video call you may also tell us about your goal (rent, sell or live in), your budget or financing, where you want to build, whether you have a lot, and a phone number if you want us to follow up by phone.
- Messages: anything you send us by email, phone or social media.
- Clients (after a signed contract): contact and billing details; your contract and project documents; information about your lot, house plans and permits; the owner documents needed for online notarization and permits; a bank-issued document showing that the U.S. bank account used to fund your build belongs to you or to a company you own or control; and records of your payments.
Contractor registrations
If you register on our For Contractors page, we collect your name, company name, email and phone number; your trades; the cities where you work and which of our cities you can cover; your Florida license number, if your trade requires one; whether you have workers' compensation coverage (or a state exemption) and general liability insurance; your years in business and languages; the photos of your work you upload; anything else you tell us in the form; and your consent.
We do not ask for sensitive personal information through our website. Card and bank payments made in the investor portal are handled by a payment provider, and we do not store your full card number.
Information collected automatically
- Technical data: like most websites, our hosting servers record data such as your IP address, browser, device, the pages you visit and the date and time. We use it to keep the site secure and working.
- Cookies: see Cookies and tracking.
Investor portal and site cameras (clients only)
- Portal: your login details, your activity in the portal and the files we share with you.
- Site cameras: video of your build site, from an outside camera starting at the foundation and an inside camera on the kitchen once drywall is installed. The video may show workers or visitors on the site.
3. How we use your information
We use your information only for the purposes below. For visitors in the EU and UK, the right column shows the legal basis under the GDPR.
| Purpose | Legal basis (GDPR) |
|---|---|
| Send you the free guide and our emails | Your consent |
| Schedule and hold your Strategy Session and answer your questions | Steps you ask for before a contract; our legitimate interest in replying to you |
| Review your contractor registration, check your license and insurance, and contact you about work in your area | Your consent; steps you ask for before working with us; our legitimate interest in building a network of vetted contractors |
| Manage your build: contract, budget, quotes, funding, payments, permits, portal, cameras and closing package | Performance of our contract with you |
| Verify that funds come from a U.S. bank account you own or control, and keep tax, accounting and legal records | Legal obligations; our legitimate interest in preventing fraud and money laundering |
| Keep our website and accounts secure and block spam and fraud | Our legitimate interest in security |
| Measure how visitors use our website (Google Analytics) | Your consent |
| Improve our website, content and services | Our legitimate interest in improving what we offer |
We do not use automated decision-making or profiling that has legal or similarly significant effects on you.
4. Who we share it with
We do not sell your personal information, and we do not share it for targeted (cross-context behavioral) advertising. We share it only when needed, with:
- Service providers who work for us: website hosting, email marketing and Instagram message automation (Builderall, including MailingBoss), online scheduling, video calls (Zoom), the investor portal, e-signature and online notarization, payment processing, site cameras, cloud storage and website analytics (Google Analytics). They may use your information only to provide their service to us.
- The people who work on your build (clients only): our General Contractors and our vetted subcontractors and suppliers receive only the project details they need, such as the site address, plans and schedule.
- Our clients (registered contractors only): we do not share your registration with anyone outside Smart Builds. If you work on a build, the client sees your company name, your quote and your final bill in their investor portal, and may see you on the site cameras.
- Independent professionals you choose to hire: if you ask us to introduce you to a licensed engineer or a realtor, we share your contact details with them. You hire them directly, and they handle your information under their own policies.
- Government offices: the permit and notarized owner documents we submit to the building jurisdiction for you, and any information the law requires us to provide.
- A future company: if Smart Builds is registered as a company, reorganized, merged or sold, your information may pass to that company, which must keep protecting it under this policy.
5. Cookies and tracking
Necessary cookies: needed for the website to work and stay secure, such as page caching, security and remembering your cookie choice. They are always on.
Analytics cookies (only with your consent): we use Google Analytics 4 to understand how visitors use our website, for example which pages they visit and which channel brought them (Google, LinkedIn, Instagram or email). It does not tell us who you are. We have turned off Google signals and advertising features, and we do not use this data for ads. Google Analytics loads only after you click "Accept" in our cookie banner; if you deny, it does not run. Google Analytics deletes the detailed data about your visits after 14 months.
Our guide sign-up form: when you use it, our email provider (MailingBoss, part of Builderall) saves in your browser the name and email you type, the step of the form you are on, and a subscriber identifier. The identifier recognizes you as a subscriber on later visits and links clicks in our emails to your subscription. This data stays in your browser until you clear your browsing data, and the form needs it to work.
Changing your choice: use the "Manage consent" button available on every page.
See the full list of cookies in our Cookie Policy.
We do not use advertising cookies or tracking pixels on our website. We use Google Search Console to see how our pages appear in Google search results; it does not place cookies on your device.
Web fonts: our pages load their fonts from Google Fonts. To deliver them, Google receives your IP address and basic browser data, as with any web request. Google does not set cookies for this, and we do not receive any information from it.
Third-party tracking: we do not allow third parties to collect personal information about your online activities over time and across different websites for advertising when you use our website.
Links to Instagram, LinkedIn and Zoom take you to those services, which have their own privacy policies. If we add advertising tools, we will update this policy first and, where the law requires it (for example, for visitors in the EU and UK), ask for your consent.
Do Not Track and Global Privacy Control: some browsers send these signals. We do not track visitors across other websites or sell personal information. If your browser sends one of these signals, we treat it as a refusal of analytics cookies.
6. Our emails
You receive our emails only if you sign up for them. Following the U.S. CAN-SPAM Act, every marketing email includes our postal address and an unsubscribe link. Unsubscribing takes effect promptly, within 10 business days at most. If you are a client, we will still send you emails about your contract and your build.
7. How long we keep it
- Guide and email list: until you unsubscribe or ask us to delete your information. After you unsubscribe, we may keep your email address on a "do not email" list so we never write to you again.
- Strategy Session bookings and notes: as long as we reasonably need them to follow up with you. Then we delete them.
- Client and project records: for the length of your project and afterward for as long as tax, accounting, contract and construction-record laws require.
- Investor portal: your access stays open for one month after closing, then it is closed unless you have another project with us. Your closing package is delivered as PDF files so you keep your own copy.
- Site camera video: only as long as your project needs it.
- Contractor registrations: as long as we may work with you, or until you ask us to update or delete your registration. If you work on a build, your quotes, bills and related records are kept with that project's records.
8. How we protect it
We use reasonable administrative, technical and physical safeguards: access limited to the team members who need it, password-protected accounts, encrypted connections (HTTPS) and established service providers. Please keep your portal password private. No system is 100% secure, so we cannot guarantee absolute security.
If a security breach affects your personal information, we will notify you and the authorities as the law requires, including under the Florida Information Protection Act (generally within 30 days) and, for visitors in the EU and UK, the GDPR (the supervisory authority within 72 hours when required).
9. Your rights and choices
Wherever you live, you can ask us to:
- See the personal information we have about you and get a copy.
- Correct information that is wrong or incomplete.
- Delete your information.
- Stop sending you emails, or withdraw any consent you gave us.
How to ask: email george@smartbuildsbrightwealth.com with the subject "Privacy request." We may need to confirm your identity first. We confirm that we received your request within 10 business days and reply within 45 days, or within one month if the GDPR applies to you (for complex requests we may extend that time and will tell you why). It is free, and we will never treat you differently for using your rights. We may keep information the law requires us to keep, such as contract and tax records.
U.S. state privacy laws: some states, such as California, Virginia, Colorado and Texas, give their residents specific privacy rights. Some of these laws may not apply to a business of our size, but we honor the requests above for every U.S. resident. We do not share personal information with third parties for their own direct marketing.
10. Visitors in the EU and UK
If you are in the European Economic Area, the United Kingdom or Switzerland, these rules also apply:
- Legal bases: we use your information on the legal bases shown in section 3.
- Your rights: access, rectification, erasure, restriction of processing, data portability, and objection to processing based on our legitimate interests. You can object to direct marketing at any time. You can withdraw your consent at any time; this does not affect what we did before you withdrew it.
- Do you have to give us your data? Your name and email are needed to send you the guide or book your session. Without them we cannot provide those services.
- International transfers: Smart Builds works in the United States, so your information is processed in the U.S. Where the GDPR requires a transfer safeguard, we rely on those offered by our providers, such as the EU-U.S. Data Privacy Framework (and its UK and Swiss extensions) or Standard Contractual Clauses. You can ask us for more information by email.
- Complaints: you have the right to file a complaint with the data protection authority in the country where you live or work. We would appreciate the chance to fix the issue first, so please write to us.
11. Children
Our website and services are for adults investing in real estate. They are not directed to children under 13, and we do not knowingly collect information from anyone under 18. If you believe a minor has given us personal information, contact us and we will delete it.
12. Changes to this policy
We may update this policy as our services or the law change. We will update the "Last updated" date at the top and, if the changes are important, we will let you know by email or with a notice on our website.
